The Land Mobile Communications Council (LMCC) filed an ex parte letter with the Federal Communications Commission (FCC) today in support the request made by the Utilities Technology Council, a member of the LMCC, that the FCC issue a Notice of Proposed Rulemaking (NPRM) in the 2014 proceeding regarding technical and operational flexibility in the rules governing the Part 22, Subpart E, Paging and Radiotelephone Service. In addition, the LMCC reminded the FCC of comments filed previously in this proceeding in which it noted inconsistencies between the rules governing the Part 22 spectrum and those applicable to VHF and UHF Part 90 spectrum operated by private land mobile radio entities. These inconsistent regulations inhibit optimal use of Part 22 spectrum. The LMCC argues that adopting an NPRM that both supports greater flexibility and removes regulatory inconsistencies would support Commission efforts to promote flexible allocations and more intensive use of spectrum.
